Acceptance of Terms of Usage
These Terms of Usage govern your access and use of this Site. By accessing or using this Site, you agree to be bound by these Terms of Usage and any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Usage.
Creative Plastic Cards (trading as Creative Print Group) reserves the right to make changes to this Site and these Terms of Usage at any time without prior notice. You should review these Terms of Usage each time you access this Site.
You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our discretion, by sending an email to the address you provided when registering. You may withdraw your consent to receive communications electronically by contacting customer care. However, if you withdraw your consent, you must discontinue your account usage.
General
All terms, conditions, and transactions occurring online at creativeplasticcards.com.au or by phone are subject to the laws of the State of New South Wales. Creative Plastic Cards is not responsible for delays or damages resulting from machinery breakdown, acts of God, or other actions, including but not limited to war, riot, seizure, or embargo. The tools available on creativeplasticcards.com.au to create documents are the property of Creative Plastic Cards and its affiliated companies. The Buyer’s order shall be deemed acceptance of the Seller’s terms. These terms and conditions shall be governed by the laws of the State of New South Wales.
Reservations
All orders are subject to acceptance by Creative Plastic Cards. We reserve the right to reject any order at any time without recourse. We also reserve the right to change pricing at any time, even after receiving an order.
Returns
Due to the custom nature of our products, returns for change of mind are generally not accepted once an order has been processed, completed, or shipped. Any claims for defects, damages, or shortages must be made in writing within seven (7) days of receipt. We will replace or refund orders that were processed incorrectly or arrive with manufacturing defects. Replacement will occur only after receipt of the returned merchandise. We will not replace orders if it is determined that they were misused or mishandled by the Buyer, or if part of the order was used before being returned. Nothing in these terms excludes any statutory guarantees that cannot be excluded under Australian Consumer Law.
Credit Card
If the Buyer’s credit card is declined, Creative Plastic Cards will not process the order. If an order is shipped and the Buyer’s account becomes overdue, the Buyer agrees to pay a monthly finance charge of 2% (annual percentage rate of 24%) on the unpaid balance. If an account exceeds the due date, unless specific arrangements are made, future purchases will require advance payment. If legal action is required to enforce this agreement, the Buyer agrees to pay reasonable legal fees and costs.
Warranty
Creative Plastic Cards does not provide explicit warranties beyond the rights provided to consumers under the Australian Consumer Law. Where a major failure occurs, we may, at our discretion, replace a defective product or credit the purchase amount.
Shipping
Shipping terms are F.O.B. Creative Plastic Cards will arrange shipping with the carrier on behalf of the Buyer. The Buyer is responsible for shipping and handling costs. Creative Plastic Cards is not responsible for delivery delays, loss, or damage while the order is with the carrier. The Buyer is responsible for any local duties or taxes.
Limitation of Liability
Subject to any statutory obligations under Australian Consumer Law, Creative Plastic Cards is not liable for incidental or consequential damages resulting from any performance or non-performance of obligations. We shall not be responsible for financial losses, costs, damages, or economic damages. The Buyer agrees not to hold Creative Plastic Cards responsible for claims related to copyright violations, trademarks, or personal rights.
Cancellations and Refunds
Creative Plastic Cards and its affiliated companies will not refund money for shipped orders or those cancelled after processing. If an order is cancelled after requesting proof approval (before production), a $50 admin fee will apply.
Privacy and Data Protection
We are committed to protecting your privacy in accordance with the Australian Privacy Principles. By using this Site, you consent to the collection, use, and storage of your personal information (such as name, email, shipping address, and artwork files) necessary to process your orders, manage your account, and improve our services.
All online credit card transactions are processed securely through our third-party payment gateway, Stripe. Creative Plastic Cards does not store your full credit card details on our servers.
By registering an account or placing an order, you agree to receive our email newsletter and marketing communications. You may opt out of these marketing emails at any time by clicking the “unsubscribe” link at the bottom of the email or by contacting customer care.
We do not sell or rent your personal information to third parties. We only share data with trusted partners essential to fulfilling your request (e.g., Stripe and courier services). You have the right to access, correct, or request the deletion of your personal data at any time by contacting our customer care team.
Print and Quality
At Creative Plastic Cards, we prioritise the maintenance of our equipment according to the manufacturer’s specifications to ensure consistent print quality. Each of our printers is individually calibrated for the specific materials used. However, due to the inherent nature of printing and the variety of substrates available, we cannot guarantee an exact colour match across different printers or when compared to computer monitors.
